These terms govern your use of this website, including the LL97 penalty calculator, the exposure reports we send, and the Journal. By using the site, you accept them. They're short and written to be read.
1. What our estimates are — and aren't
Everything this site's tools and reports produce is a modeled estimate, not a compliance determination. Figures are calculated from public New York City benchmarking disclosures and statistical models of comparable buildings. They exist to show you the shape and scale of your exposure so you can make informed decisions about next steps.
They are not: a filed Local Law 97 report, an energy audit, a legal opinion, a guarantee of what the Department of Buildings will assess, or a substitute for advice from a licensed engineer, attorney, or accountant. Actual obligations depend on your building's verified data, its filings, and rules that the City updates over time. Do not make capital or legal decisions on an estimate alone — that's precisely what our full engagements are for.
2. No professional relationship until we both sign
Requesting a free report, using the calculator, or booking a call does not make you a client. A professional engagement begins only when we both agree to a written scope of work. Until then, information we provide is general guidance offered in good faith.
3. Using the site
- Use the calculator and tools for evaluating buildings you own, manage, serve on the board of, or otherwise have a legitimate interest in.
- Don't scrape, bulk-harvest, resell, or misrepresent the data or reports as your own product.
- Don't submit information about other people without their permission.
- Don't use the site in any way that violates the law.
4. Your submissions
Information you submit through our forms is handled as described in our Privacy Policy. You're responsible for the accuracy of what you submit — our reports are only as good as the address you give us.
5. Our content
The text, design, data compilations, and tools on this site belong to Scope Energy NYC. You're welcome — encouraged, actually — to forward our reports and articles to your board, your managing agent, or anyone weighing an LL97 decision, with attribution intact. Republishing our content commercially requires our written permission.
6. Third-party services and links
This site runs on the Wakato platform, and we link to external resources (NYC government pages, NYSERDA, and similar). We don't control those services and aren't responsible for their content or availability.
7. Limitation of liability
To the fullest extent permitted by law, Scope Energy NYC is not liable for indirect, incidental, or consequential damages arising from use of this website or reliance on its free estimates — including penalties assessed by any government agency, lost profits, or decisions made on the basis of modeled figures. Where liability cannot be excluded, it is limited to the amount you paid us for the service in question (for the site's free tools, that amount is zero). Nothing in these terms limits liability that cannot lawfully be limited.
8. The site is provided "as is"
We work to keep the site accurate and available, and we correct errors when we find them — publicly, when they matter. But we can't warrant that the site will be uninterrupted or error-free, and public datasets sometimes contain errors we inherit. If you spot one, tell us; we'll fix it.
9. Changes
We may update these terms; the effective date above will change when we do. Continued use of the site after a change means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the State of New York, and any dispute will be resolved in the state or federal courts located in New York County, New York.
